Elite Wealth Capital Investment Platform Agreement

By accessing and using the Elite Wealth Capital platform (hereinafter "the Platform"), including our website, mobile applications, and services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). These Terms constitute the entire agreement between you ("User") and Elite Wealth Capital, Inc. ("EWC" or "we" or "us" or "our") regarding the use of our services.
If you do not agree to these Terms, do not access or use the Platform. Your continued use of the Platform following any modifications to these Terms constitutes your acceptance of such modifications.
Eligibility: You must be at least 18 years old and a legal resident of an approved jurisdiction to use our Platform. You represent and warrant that:
Account Security: You are responsible for maintaining the confidentiality of your login credentials and account information. You agree to notify us immediately of any unauthorized access or suspicious activity. EWC shall not be liable for any losses resulting from unauthorized access due to your negligence.
Investment Minimum: The minimum initial investment is $500 USD (or equivalent in other supported currencies). Additional investments may be made in increments as low as $100.
Risk Disclosure: All investments carry inherent risks, including the potential loss of principal. Past performance is not indicative of future results. Market conditions, geopolitical events, and economic factors can significantly impact investment returns. You acknowledge that you understand and accept these risks.
Portfolio Management: EWC offers three management options:
Fee Structure: Management fees vary based on portfolio size and service level, typically ranging from 0.25% to 1.5% annually. A detailed fee schedule is available in your account dashboard. EWC may adjust fees with 30 days' notice.
Withdrawal Rights: You may request to withdraw your funds at any time without penalties or lock-in periods. Standard withdrawal requests are processed within 24 business hours of submission.
Processing Timeline: Withdrawal processing occurs on business days. Requests submitted after 2:00 PM EST are processed the following business day. Bank transfers may require additional 1-3 business days to appear in your account.
Withdrawal Restrictions: We may temporarily restrict withdrawals if:
Partial Liquidation: You may request withdrawal of partial amounts while maintaining a minimum of $100 in your account (or $500 for certain account types).
Complaints Process: If you have a complaint, contact our Compliance Department at compliance@elitewealthcapita.uk with details of your grievance, transaction references, and supporting documentation.
Resolution Timeline: We acknowledge complaints within 2 business days and provide a preliminary response within 7 business days. Final resolution is typically provided within 30 days.
Escalation: If you are not satisfied with our response, you may escalate to our Executive Management Team or file a complaint with relevant regulatory authorities in your jurisdiction.
Arbitration: All disputes arising from these Terms shall be resolved through binding arbitration in accordance with applicable laws. You waive your right to pursue class action litigation. Each party bears their own legal fees unless arbitration rules specify otherwise.
Disclaimer: EWC provides the Platform "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted service, error-free operation, or specific investment returns.
Limitation: Except where prohibited by law, EWC's liability is limited to the total fees paid by you in the 12 months preceding the claim. In no event shall EWC be liable for:
Force Majeure: EWC is not liable for failures or delays caused by events beyond reasonable control, including natural disasters, wars, government actions, or internet infrastructure failures.
Third-Party Services: EWC uses third-party service providers (banks, custodians, exchanges). We are not responsible for their errors, failures, or misconduct beyond our reasonable supervision.
Privacy and Data Protection: Your personal data is governed by our Privacy Policy, which complies with GDPR, CCPA, and other applicable privacy regulations. We maintain strict data security protocols and will never sell your information to third parties without explicit consent.
Intellectual Property: All content, features, and functionality of the Platform are owned by EWC or licensed to EWC and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, or distribute this content without permission.
Prohibited Activities: You agree not to:
Termination: We may terminate or suspend your account if you violate these Terms, engage in illegal activity, or pose a risk to our operations. Termination does not affect your right to withdraw your funds.
Modifications: EWC reserves the right to modify these Terms at any time. Continued use of the Platform following notification of changes constitutes acceptance.
